These Terms and Conditions govern the use of the While in Como website and booking platform located at whileincomo.eu and any related mobile applications (collectively, the "Platform"). The Platform is owned and operated by While in Como Srl ("While in Como", "we", "us" or "our"). While in Como provides an online platform that enables users ("Members") to search for, book and pay for tours, activities and other local experiences ("Experiences") offered by local providers ("Suppliers").


Please read these Terms carefully as they contain important information about your legal rights, remedies and obligations. By accessing or using the Platform, you agree to comply with and be bound by these Terms.  


If you do not agree to these Terms, you may not access or use the Platform.


  1. Our Role

1.1 While in Como's Role. We provide an online platform that enables Members to publish, search for, book and pay for Experiences offered by Suppliers. We act as the limited payment collection agent of the Supplier for the purpose of accepting payments from Members on behalf of the Supplier.  


1.2 No Endorsement. While in Como does not own, control, offer or manage any Experiences. Suppliers are independent third parties, not employees or agents of While in Como. We do not verify Supplier information and make no representations about any Supplier or Experience. We do not endorse any Supplier and are not responsible for any aspect of the Experience.


1.3 Reservation Contracts. Reservations for Experiences are between the Member and the Supplier. When you make a booking, you are entering into a direct contract with the Supplier and are responsible for all amounts owed under that contract.


  1. Member Accounts  

2.1 Registration. You must register an account to access certain features of the Platform. You represent and warrant that you are 18 years of age or older and have the authority to enter into contracts. You agree to provide current, accurate, and complete information during registration and to update your information to keep it accurate and complete.  


2.2 Security. You are responsible for safeguarding your password and account information and agree not to disclose your password to any third party. You must immediately notify While in Como if you become aware of any unauthorized use of your account. You are solely responsible for activities conducted through your account.


  1. Bookings

3.1 Booking Process. The booking process allows you to search for available Experiences, select an Experience, date and number of tickets, and provide payment information. All information provided during booking must be accurate. Your booking constitutes an offer to purchase the selected Experience, which will either be accepted or rejected at the Supplier's sole discretion. 


3.2 Prices, Fees and Taxes. The prices displayed for Experiences are set by the Supplier. Prices may change at any time prior to booking. Applicable taxes and While in Como's service fees will be shown prior to booking. You are responsible for paying all amounts owed for your booking.  


3.3 Payment Authorization. By submitting payment information, you authorize While in Como to collect payment on behalf of the Supplier plus applicable taxes and fees. Certain payment services may charge additional fees for use of their service. 


3.4 Confirmation. A booking confirmation will be provided upon acceptance of your offer. You must verify all booking details are accurate. While in Como may cancel any booking made in error.


3.5 Reselling Forbidden. Bookings are for personal use only. Reselling or offering to resell any booking is prohibited.


  1. Cancellations, Changes and Refunds

4.1 Cancellations. Cancellations must be made through the Platform or by directly contacting the Supplier. Refunds for cancellations are determined by the Supplier's cancellation policy, which will be made available prior to booking.  


4.2 Changes. Changes to bookings must be made through the Platform or by directly contacting the Supplier. Change requests are subject to availability and approval by the Supplier. Additional fees may apply.


4.3 Refunds. Refunds are processed according to the applicable cancellation policy. While in Como will issue refunds on behalf of the Supplier and has no obligation to provide refunds other than those required by the Supplier's cancellation policy. Refund methods may differ from original payment method.  


4.4 Failure to Participate. No refunds will be provided if you fail to participate in the Experience on the booked date and time.


  1. Supplier Terms and Policies

Suppliers may maintain their own terms, conditions, policies and guidelines that apply to their Experiences. You are responsible for reviewing all applicable Supplier terms and complying with any rules, standards and eligibility requirements described therein. Certain Experiences may involve outdoor activities, physical exertion, or interaction with animals, which may carry inherent risks. You assume responsibility for verifying you are physically capable of participating and following all safety rules and protocols.  


  1. Member Conduct 

You agree to act responsibly, showing due consideration for people, places, things and the environment when participating in an Experience. You will comply with all laws, policies and safety standards that apply to the Experience or location. Suppliers have the right to refuse participation or immediately terminate involvement of any Member for unsafe, inappropriate or illegal behavior.


  1. Ratings and Reviews

Members who complete an Experience may write a public review. You agree that any review you write will be accurate and lawful. While in Como reserves the right to remove any review that violates these Terms.


  1. Intellectual Property

The Platform and its original content, features and functionality are owned by While in Como and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. You may not copy, modify, create derivative works from, distribute or publicly display any content from the Platform without express written permission from While in Como.


  1. Liability Disclaimer 

While in Como shall not be liable for any act, omission or failure to act by any Supplier or for any direct, indirect, punitive, incidental, special or consequential damages arising from your use of the Platform.


  1. Indemnification

You agree to indemnify and hold While in Como harmless from and against any claims, liabilities, damages, losses and expenses arising out of (i) your breach of these Terms, and (ii) your acts or omissions when participating in an Experience.  


  1. Termination 

We reserve the right to terminate your access to the Platform if you breach these Terms. You have the right to close your account at any time.  


  1. Changes to these Terms 

We reserve the right to amend these Terms at any time. Updated versions will be posted on the Platform and are effective immediately. Continued use of the Platform indicates acceptance of any changes.


  1. Governing Law and Jurisdiction

These Terms are governed by Italian law. Any disputes arising in connection with these Terms shall be resolved by the courts of Como, Italy.
